Repeal s.43 missing from proposed Criminal Code amendments


First Call is disappointed to see that proposed amendments to Canada’s Criminal Code do not include repeal of section 43, Correction of Child by Force.  Minister Wilson-Raybould promised to repeal s.43, as part of the government’s pledge to implement all the Truth and Reconciliation Commission Calls to Action – see #6 under Education.

We call on your government to repeal section 43 of the Criminal Code to uphold children’s right to protection from “all forms of physical or mental violence” while in the care of parents or others. Allowing parents or teachers to hit children for “correction” reflects a 19th century approach to children that ignores their rights and contributes to child abuse.
